As to the possible eventualities to which I have referred I should point out that the Ordinance creating the new Full Court is intended to be personal to Sir Havilland de Sausmarez and his attendance at llongkong must be subject at all times to the exigencies of the work at Shanghai" (condition laid down by Sir Edward Grey in Secretary of State's confidential Despatch of 27th. September, 1911). If therefore illness or other urgent reasons

prevent his attending at a session we should have to fall back on

the temporary appointment of a barrister of not less than seven

years standing, an alternative which I think is almost impracticable

having regard to the fact that probably all the barristers of

standing and capacity are likely to be concerned in most of the

appeal cases. The question therefore arises whether Sir Frederick

Lugard's opinion based "on a consensus of opinion" that "an appeal Court which shall rely upon a Judge of the Shanghai Court willmot long be adequate for the needs of the Colony" is not- justified by the facts ? (Confidential despatch of Sir F. Lugard to Secretary of State 29th. December, 1911, paragraph 13).

8. The amendments suggested in paragraphs 5 and 6 are

of course contingent on the present scheme being adhered to.

9. If there are any other points on which you may require information I would suggest that I may amplify the position in an interview with Your Excellency.
